Buyer’s responsibility
It is the buyer’s responsibility to provide accurate drawings/floor plans and all other information requested per our website, bbsystemdesign.com, including the size of the house, type/brand of equipment, preferred temperature, the direction of the front door, number of systems, size (WxH) of windows and exterior doors and more. If no window/door sizing is provided/properly marked, all windows will be standard 3x4ft (excluding bathroom windows 2x3ft and basement windows 2x1ft). It is also the buyer’s responsibility to check with their local municipality on what report they need, along with all the licensing and permit issuing requirements they may need, and the buyer’s responsibility to order the right set of services from us.

Revisions
I offer free revisions (on a case-by-case basis) except for Changes in the floor plans, changes that lead to a redesign of the system, and Requests that go against the code and best installation practices. Any Revisions that don’t count towards the free revisions will be charged at $60/h with a minimum charge of $60.
*Example of what counts as a free revision: You would prefer to add a vent at a specific location.
*Example of what doesn’t count as a free revision: You decide to move/add/remove rooms/windows/doors in your house which leads to a redesign of the house and the duct system leading to a brand new Manual JDS.

Payment
The order must be paid in full before any service is performed. Once you fill out the Requirements form and send us the floor plans, we will review them and send you a price quote with a FreshBooks link where you can make the payment.

Canceling an order
As long as I haven’t started work on the order, it can be canceled and fully refunded (I usually start work instantly or up to a day after the order has been placed). If I’ve designed the house (Manual J&S) but haven’t done the duct design (Manual D) yet, I can refund you the price difference between the projects (Example: Manual JDS is 280$, Manual JS is 125$. You will get 155$ refund). A refund can’t be issued if the project has already been completed. If you haven’t paid for an Express Delivery, the project might already be completed but not delivered yet.
*Express 24-hour delivery orders can’t be refunded, as the work starts instantly so that I can deliver on time.

Liability
Liability is limited to the price of the project.
As I cannot guarantee that the HVAC contractor or the homeowner will install the system properly and the way it was designed, I’m not liable for its performance or any issues that might arise from that. All information used in the creation of the manuals is provided by the buyer, and they are responsible for providing me with accurate information. When information is not available or missing, I may make assumptions. It is the customer’s responsibility to review the reports carefully and review the sq ft of the space, the building construction assumptions, the underlying construction assemblies, the design temperature, and the design weather station used before the installation of equipment.


For Manual J, Manual S, and Manual D:

What’s included in the Manual JDS package? A Residential Manual J (Load calculations), Manual S (Equipment selection), and Manual D (Duct design). The manuals are performed using the ACCA-approved software “Wrightsoft” and follow ACCA Manual JDS standards.

What’s NOT included in the Manual JDS package? Anything not covered by Manual JDS, ERV/HRV Design, any documents, state-specific forms (can be filled by the contractor/homeowner), and an engineering stamp which is not required for Residential projects. Licensing, site plan, zoning, and installation requirements are separate from the Manual JDS design and are outside the scope of the project.
*Some towns may require additional licensing/certifications that are outside the scope of our work, which is limited to ACCA-compliant sizing of your heating/cooling & ductwork and equipment selection. ​


For Radiant Design:

What’s included in Radiant design? Radiant Heating Design Room by room load calculation, list of tubbing and manifolds required for the loop installation, and a visual layout of tubbing with spacing and loop length.

What’s NOT included in Radiant design? Material takeoff
*Some towns may require additional licensing/certifications that are outside the scope of our work, which is limited to ACCA-compliant sizing of your heating/cooling & ductwork and equipment selection. ​

For Rescheck:

The only way to create a Rescheck is to use a Government website, which sometimes may be down for planned maintenance or unplanned crashes. Depending on how long the website is down, the delivery time of the project may be extended. Most of the time, they issue a warning for planned maintenance, but unplanned crashes do happen, and they’re out of my control.


Dispute Process
In the unlikely event that you don’t agree with our calculations or don’t like what we’ve sent you, we urge you to bring you to message us so that we can discuss why things were made the way they are or what needs to be changed to achieve what you need.
Please keep in mind that there are limitations to what we can do. Your house’s size is your house’s size, and this won’t change. Things such as the ceiling height, windows or doors, and even rooms such as kitchens that require more BTU will affect the load, so two houses with the same sqft might have different load requirements.
Everything is calculated by a program approved by the “Air Conditioning Contractors of America-ACCA,” so the end result is what it is and cannot be changed (for example, 2+2 is always going to = 4, and while I know you would really want it to =6, it can’t be done). We can edit the inputs if you provide us with different information.

*If we are unable to resolve a dispute, then you agree to take the disagreement to binding arbitration. The loser of that dispute will pay for the arbitration services. 
*Any disputes and any claims requiring court action must be filed in the courts of Cumberland County in NJ. Jurisdiction for any disputes shall be Cumberland County, New Jersey.  
*Further, please note that some contractors may dispute the sizing from this report(s) as it is common practice to substantially oversize the units by using old-school formulas that aren’t ACCA-approved. This is the reason why municipalities no longer trust those random calculations and require a Manual JDS to be performed. There are several problems associated with oversizing; thus, we will only deliver ACCA Manual JDS-compliant reports, as required by today’s codes. Statements such as “My contractor said this system is too small/too big by their old-school formula isn’t a qualifying reason for a revision or a dispute”.   
*Please note that if you want a hack service that oversizes and does not comply with ACCA Manual JDS, then this is not the service for you and we are not the company for you. Please use someone who does not comply with Manual JDS but rather uses the square feet method, which was developed in the 1950s and is inadequate for today’s homes.
*For any disagreements, you agree to binding arbitration and not credit card dispute methods.  You must bring a substantial proof of your disagreement for any disputes about the validity or accuracy of the calculations, duct layout, or duct sizing.  To do that, you agree to use only someone with the ACCA Residential HVAC Design For Quality Installation certification, at least 10 years of HVAC system design, and a Master HVAC license.  Finally, you agree that any alternative calculations you bring to the dispute must be performed using software approved by “Air Conditioning Contractors of America – ACCA”.  In short, simply saying, “This is wrong because a contractor says so,” “I am not happy,” or “This is not what I thought I would get,” is not a valid ground for a dispute.
